1. General
Parents will be deemed to be aware of the NL4Kids procedures.
These terms and conditions apply to all sales and agreements between NL4Kids and the parent, whereby NL4Kids will apply these conditions unless otherwise agreed in writing.
2. Information
NL4Kids respects the privacy of visitors on this site and does not provide information obtained to third parties, except when the information is required for the services that NL4Kids provides to the parent, when necessary for the course, or when legally required upon request of the appropriate legal authorities.
Records of NL4Kids website visits are kept for statistical purposes .
The personal data that NL4Kids collects about its parents and children will be carefully and adequately processed.
3. Copyright
NL4Kids holds the copyright on the content of this website. It is not allowed to copy content from this site without our written consent.
4. Product and Services
A parent must provide true, accurate, current and complete information and will maintain and promptly update this information if any changes occur. If the parent provides, or if NL4Kids suspects that the parent has provided false, inaccurate, outdated or incomplete information, NL4Kids may cancel the course the parent has registered his or her child for.
NL4Kids needs all the required information about the parents child in advance of the start date of the course. The child cannot attend the course if this is not the case. All the required information is asked on the registration form on the website. Therefore NL4Kids can only handle an application based on a completely filled out and send registration form.
A parent will not in any way restrict or inhibit any other user from using and enjoying the NL4Kids website. A parent will use the website only for lawful purposes and is prohibited from posting on or transmitting through the NL4Kids website any unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, sexually explicit, discriminating, profane, hateful, fraudulent, racially, ethnically or otherwise objectionable material of any kind, including, but not limited to, any material that encourages conduct that would constitute a criminal offense, give rise to civil liability, or otherwise violate any applicable local, state, national or international law.
Despite any other established legal rights, NL4Kids is entitled, at its own choice, in case of 'force majeur', to cancel a course without legal intervention, by informing the parent in writing. The parent is not entitled to any damages caused by this cancellation.
5. Prices & Payments
All prices indicated on the NL4Kids website are in Euros and are VAT free under Dutch law.
Parents may make payments electronically to NL4Kids.
The fee of the course of registration has to be paid to NL4Kids four weeks in advance of the start date of the course. If no payment is received in time NL4Kids has the right to cancel the course for the parents child. In other words: a child can only attend a course when the total fee of the course has been paid to NL4Kids four weeks in advance.
A course has to be taken within the agreed period.
6. Money Back Guarantee
If the parent, for whatever reason, does not wish his or her child to attend the course, the parent has the right to cancel the course in writing to NL4Kids, within five working days after the payment for the course has been done by the parent. The money will then be refunded by NL4Kids to the parent.
If the parent wishes a money refund after the five working days term, this will be not in our remit.
There will also not be a money refund if the child is skipping classes through illness or any other reason, or drops out of the course by whatever reason.
7. Liability and Cancellations
NL4Kids will not assume any liability for any direct or consequential damage, be it physical, material or immaterial, resulting from the course.
The parent is responsible to take the child to the course location and to pick him or her up at the end of each course lesson at the right and agreed time (ending time of the lesson). NL4Kids cannot be hold responsible for the wellbeing of the attending children before or after the course lesson.
If NL4Kids is unable to start a course that have been paid for, NL4Kids will provide a full refund within 28 days of cancellation. If NL4Kids is obliged to cancel a course that has been partly completed, the refund will be on a pro rata basis. A cancellation may be made due to illness, accident or other reason, such as natural disaster. Every effort will be made to meet the order and find replacement teachers when necessary, but if it becomes necessary to cancel, NL4Kids liability is limited to refunding the price of the course that has not been delivered on a pro rata basis.
If one lesson should be cancelled by NL4Kids (for example because the instructor is ill), this lesson can be regained the week after the course has officially ended. In that case this course will take eleven weeks, instead of ten weeks.
All of the information on NL4Kids website (www.NL4Kids.nl) has been carefully compiled. However, there is a chance that certain information is not correct, or complete, or current. NL4Kids cannot be held responsible for this in any way. Furthermore, NL4Kids cannot be held responsible for information and prices that have been made due to such default information, that have been placed on its website by third parties.
8. Queries or Complaints
In the case of queries or complaints concerning any of our courses, teachers or procedures, please contact us by email (Jasja@nl4kids.nl). You will receive a reply within three working days.
9. Applicable Law and Jurisdiction
All rights, obligations, specials, orders and agreements that fall under these General Terms and Conditions, and under this condition, are applicable under Dutch Law and Jurisdiction.
10. Acceptance of General Terms and Conditions
All website users are required to be aware of, and to agree with, all of the above General Terms and Conditions. By filling in the registration form, the parent automatically agrees to all of our General Terms and Conditions.
NL4Kids reserves the right to make changes to these General Terms and Conditions at any time. The parent will be subject to the General Terms and Conditions in force at the time when the parent uses the website and registered his or her child to a course, when the child is following the course, until the course has ended. If any of the terms is deemed invalid, void or for any reason unenforceable, that term will be deemed severable and will not affect the validity and enforceability of any remaining conditions.
